Catering Terms and Conditions

Miscellaneous Charges

Attendants:

For Coatroom and Gift Registration
For restrooms; required for all events with children in
attendance (Birthday Parties, Bar/Bat Mitzvahs,
School Performances, etc.)

Audiovisual: A complete array of audiovisual equipment and

Box Handling Charges: All boxes and packages are subject to handling charge. $10.00 each
Cake Cutting/Service: Charged for all cakes brought in. $5.00 per person

Hanging:
Location of all flag, banners signs and seals must be

Labor Fee: Charged for all meal functions with fewer that 40 guests. $200.00 per event
Labor Fee/Overtime: Prices quoted are for a three (lunch) or four (dinner)
hour function. A per hour overtime charge will apply
for each additional hour or portion there of.

Linen: Standard Linen (Include Black, White, Ivory) Complimentary
Parking: Valet is required for all private events held at Spencer’s. $8.00 per vehicles
Security Officers: One officer required per twenty (20) child; six (hour)
minimum call per officer. Required for all night set-ups
and all events with children in attendance (Birthday parties,
etc.)

Additional Services
Our staff will gladly assist you with your floral, music, entertainment, printing, decorating, limousine, photography and audio/visual needs.

Deposit and Payment Methods
Deposits will be required to confirm a definite reservation. The amount of the deposit is at the discretion of Catering by Spencer’s. It is required that 100% payment be received seventy-two (72) hours prior to the event in the form of a cashier’s check or the function will be subject to cancellation

Guarantees
In arranging for private functions, the final attendance must be definitely specified and communicated to Catering by Spencer’s by 11:00 a.m. a minimum of five (5) working days prior to the event. This number will be considered a guaranteed not subject to reduction and charges will be made accordingly. Guarantees for Sunday and Monday are due by 11:00 a.m. on Tuesday. Guarantees for Tuesday are due by 11:00 a.m. on Wednesday. If a guarantee is not given by 11:00 a.m. on the date it is due, the expected number(s) indicated on the Banquet Event Order will become the guarantee. The set for groups up to 99 guests will be 10 percent (10%) over the guarantee. For groups of 100 guests or more, Catering by Spencer’s will set five percent (5%) over the guarantee up to the maximum of 30 covers. Catering by Spencer’s will not be responsible for identical serve to more than five percent (5%) over the guarantee.

Lost and Found
Catering by Spencer’s will not assume or accept the responsibility for damages to or loss of any merchandise or articles left at any event.

Menu Selection and Prices
Our creative staff will assist you in planning special menus, theme parties, weddings and events. We do ask that your final decision be submitted no later than four (4) weeks prior to the event. All menus are limited to one entrée selection, unless the "A La Carte" option is selected. All prices herein are valid through May 31, 2009 with a signed BEO. Items are subject to substitution or change due to market conditions at anytime.

Outdoor Functions
Catering by Spencer’s reserves the right to make the final decision to move a function to an indoor location. This decision will be made no less than eight (8) hours prior to the event, based on prevailing weather conditions and local forecast.

Performance
Performance is contingent upon the ability of Catering by Spencer’s to complete same, and is subject to labor troubles, disputes, strikes or picketing, accidents, government (federal, state or local) requisition, restrictions upon travel, transportation, food, beverages or supplies and other causes, whether enumerated herein or not, which are beyond the control of Catering by Spencer’s. In no event shall Catering by Spencer’s be liable for the loss or profit or other similar or dissimilar collateral or consequential damages, whether based on breach of contract, warranty, or otherwise.

Off-Premise Catering
Catering by Spencer’s is staffed and equipped to handle all of you off-premise catering events from 25-1,000 guests. We can also provide you with selected sites for your function; Museums, Celebrity Estates, Art Gardens and Desert sites. There will be a twenty percent (20%) surcharge added to the attached menus and labor fees for off-premises catering.

Parking
Valet parking is required for all private events held at Spencer’s.

Security
Catering by Spencer’s shall not assume responsibility for damage or loss of any merchandise or articles left at any function. Arrangements may be made for security officers for exhibits, merchandise or displays.

Service and Labor Fees
A taxable twenty two percent (22%) service charge and the applicable California state sales tax will be applied to all food and beverage charges. For private parties of twenty (20) guests or less, Catering by Spencer’s will assess a service charge based on labor and travel time. Buffet service for less than the minimum guests required will be subject to a minimum surcharge of $10.00 Per Guest.
